Spousal Support

The Divorce Act and Family Law Actset out factors and objectives to be considered by a Court when determining whether one spouse should pay the other spouse financial support following a separation or divorce. The law recognizes the economic consequences of a marital or common law relationship, and strives to alleviate the disadvantaged spouse?s economic position following a breakdown of the relationship. At the same time, the law promotes the economic self-sufficiency of spouses, insofar as is practicable, and within a reasonable period of time.

Based upon a review of the current case law and Spousal Support Advisory Guidelines, Berman Barristers provides advice and recommendations balancing need against the obligation to become self-sufficient and ability to pay. Our objective is to maximize the amount and duration of financial support for the payee-client and to minimize the amount and duration when acting for the payor.

As well, circumstances frequently change after an order or agreement for spousal support has been put in place. We assist clients in obtaining variations of spousal support payments in appropriate circumstances.
